I have added some dumbbells and a bench, rubberized flooring to my yoga room. This room is popular, with many guests telling me that the yoga room swayed them into booking our place.
Do I need an ‘at your own risk’ type of sign in the room? I already have liability coverage in my insurance for my str guests that is specific to the room. Someone mentioned that I should have a ‘warning’ disclaimer on the wall.
Regardless of whether your insurance agent thinks it is desirable I would ask myself if I were you whether anything needs to be written out.
For example, is it OK to bring food and drinks other than water here? Does something need to be said about putting things back where they were found? Do they need to sanitize anything after use? Can children under age x use without an adult? Maximum occupancy. And of course, “Use at your own risk.”
If it were me, I would certainly ask insurance agent. If they said ‘no,’ I would wait on the signage but make up appropriate rules for the listing, and then just wait to gain experience on what signage if any might be needed.
Seems like a pretty standard disclaimer, Rolf. Can’t say whether it would protect you if a guest got hurt and claimed the equipment wasn’t properly maintained and they therefore got hurt, if anyone ever tried to sue you (which is highly unlikely to ever happen), but I don’t see any downside to posting a sign.
Certainly in the UK those sort of ‘at your own risk’ disclaimers don’t hold any water and you could still be sued if your guest has an accident using them. You do see lots of gyms etc using them but they mean nothing say if the equipment is faulty and a guest injuries themselves.
I would ask your insurance broker about how you best cover yourself. I can’t image standard STR home insurance would cover using gym equipment in a home gym.
It wouldn’t hurt to have them sign a waiver releasing you from liability should they get hurt doing yoga or with the dumbells. I would also post something on the wall.
