You need to get a lawyer, period. This woman is a grifter and Airbnb really ain’t gonna step up. Once they have established residency you’re screwed, although it does vary by state. What you don’t want is to be counter-sued by said grifter. Really, you need to talk to a lawyer who is familiar with local landlord-tenant laws.

People DO NOT ACCEPT 30+ reservations. Especially from people with children. It is a red flag.

Oh you are so right. Platforms like Airbnb are vulnerable to people who could never lease a place due to terrible credit, bad tenancies elsewhere, criminal records, etc. and having a child in the picture makes it even worse, might not be their own kid even, see recent story in NJ! That said, proper vetting for long term tenancy is simply not done on the Airbnb platform. I own a standard 2 fam home with my brother and we have done completely background checks on all tenants which btw the tenant pays for. Also 2 months plus security deposit before they move in. AND A LEASE! We have terms to evict written in. But I digress, Airbnb is not set up to protect against bad apples, period, you are crazy if you take a chance. It can become a last resort platform for very fringy types. I’m sorry for them but I don’t want them squatting in my home.

Is there some way to find out how to know what it is in your state? In Florida it is supposedly only two weeks!

This is sooooooooo true! There should be more warnings by Air about this and there should be discouragement or prohibition of Air rentals of 30 days and over.

You should ask what the purpose of the trip is if a guest looks suspect.

Yes! Every state has its laws and regulations online for free and many websites consolidate these all into one place. In New York State Landlord-Tenant laws can fall under the code section for ā€œReal Propertyā€ but that terminology may also vary by state. In Florida it is under Landlord-Tenant.

You don’t mean the squatter, I think. You mean the lady who was squatted upon. :slight_smile: Or, perhaps the squattee.

Exactly what I was saying earlier. I’m surprised there isn’t more squatting on Airbnb. No deposit, no background check…bam! easy! All they have to do is look for someone with a DISCOUNT for a month long stay and they can stay for months!

What does UD stand for? People were using it in that thread too.

Yup… And they if the answer the notice to quit and pay a filing fee, they can get it on the court docket and remain even longer!

You misunderstand the law. IF someone is renting the entire property, they become a tenant. If they are only renting a room, no meals, a lodger. If meals, a boarder. Lodgers and boarders do not require legal eviction, they can be removed for trespassing, in most places. CHECK YOUR LOCAL LAWS.

As a Florida landlord, you are, again, mistaken. It’s a month, same as most every other state.
