Full time rental in Denmark

I bought an apartment in Copenhagen which does not have the usual danish requiements for someone to register their adress there (bopælspligt) im renting it out all the time on airbnb and it is a huge sucess. Now the owners board it thinking about limiting the number of weeks a year where you can do that. Is there any way I can fight this?

Get a lawyer? Band with others in a similar situation? Understand their concerns and work with them to address?

Probably not. I don’t know about Denmark but in my area HOAs can basically create their own rules and we just have to abide by them.

Both of our apartments are Bopælspligt and as you we rent them both out very successfully.

I believe that if the board were to make such a rule, all owners would have to vote and approve it. I don’t believe they can just implement the rule themselves.

You therefore need to persuade your fellow owners to vote against it.

As you know property prices in Copenhagen are flying upwards at the moment, especially so for property without residential status. We are constantly on the look for another such property at the right price. The real estate agents we’re working with tell us that such properties are currently commanding a 15-20% premium, with many people looking for Airbnb investment properties. Any embargo on the number of nights you can Airbnb would have a serious impact on this premium - people don’t like to see there properties devalued so this could be a very compelling argument.

How do you deal with the bopælspligt … you just dont deal with it or?

Problem is that in marts we have General assambly (generalforsamling) and I am very sure it will be discussed there. I contacted the municipality (kommunen) in order to hear if I can leagally turn it into a B&B. The answer is that as the apartment does not have Erhvervs status, it is not leagal and to change that status the board has to allow it.

Sorry - I wrote wrong, neither of our apartments need to have somebody living there.

I know of another couple getting around the ‘problem’ of not having anybody living there by registering one person at home and one at the rental.

Why does your board want to limit Airbnb nights?

We are lucky that in both of our buildings, there are lots of others renting on Airbnb. My husband is also active on both boards too.

Can you get on the HOA board? My HOA was fine with me doing Air (plus, I am not breaking any of the rules), but this summer, three of the board members said I couldn’t do it anymore. I stated that I was licensed by the City and was not breaking any of the HOA rules. I also said, “Fine, my teenage daughter and I will move in and then you can deal with all of her pot smoking hippie friends” – after which, I didn’t hear anything more from the board. To (hopefully) prevent the board from changing the rules, I got voted in last month. It’s a five person board and three positions became open. Two of my more friendly neighbors also got voted in. We have discussed forming a coalition, if needed, because they want the option to do STR in the future. Problem solved :slight_smile:

Hi! I have an apartment in Copenhagen K on a full time rental on airbnb, and my neighbors are complaining about this. There are no specific issues, some just dislike the idea of having many guests on the building. I would like to know what does the law have to say about this? Is it allowed to rent out your apartment on airbnb as much as you want, or is there a limit to the amount of weeks, or can the neighbors forbid this practice?
